Terms of use
Accessing and browsing this Platform, including the go. junoverse. app website, constitutes your acceptance of the provisions set out in these Terms of Use ("Terms").
We use the word "Platform" when referring to the website, application or service offered by Juno Go, including any communication we send out. We provide you with access to our Platform and refer to these terms and conditions.
Users of the Platform ("Users") who do not accept the contents of the Terms of Use should immediately stop accessing and navigating the Platform.
We use both "Terms of Use" and "Agreement" when referring to this document in conjunction with our Privacy and Cookie Policy, Terms of Subscription, Usage and Content Policy and Groups and Activities Policy.
Juno Go reserves the right to change these Terms of Use in whole or in part. Users who do not accept such changes should consider whether to continue accessing the Platform; use of the Platform after the posting of changes, implies acceptance of the same on the part of the User.
The wording of these Terms of Use shall be interpreted in accordance with the provisions of the legal terms of the Platform.
1. Platform activity
This platform is a marketplace specialized in the marketing and sale of leisure activities and other services ("Services").
Within the platform there are several features to inform users of activity reservations, available on the platform and to facilitate the completion of an order, such as the ability of users to:
- Register on the Platform by activating a personal account to access reserved content areas ("Personal Account");
- Connect with other members via Social features;
- Plan and organize both events and activities;
- Subscribe to the mailing list to receive newsletters related to the platform's activities and campaigns;
- Participate in promotions.
Users are encouraged to provide true, accurate and current personal information and to update their personal information ("Personal Information") at the time of registration if it is out of date and to read the Privacy Policy and the Cookies Policy in connection with the processing of Personal Information.
2. Platform content and intellectual property rights
The information, images, photographic material, products and generally all or any part of the content of the Platform ("Platform Content") are owned by Juno Go, its licensors or content providers.
All Platform Content is protected by intellectual property rights, and is including but not limited to trademark, copyright, patent, trade dress or other laws and international treaties on intellectual property rights.
Copying, downloading, distributing, modifying, creating derivative works or extracts, publishing or otherwise using or exploiting Platform Content without the prior written consent of the relevant rights holder or, as the case may be, any other rights holder, where such activity has not been expressly authorized by the Platform, is prohibited.
Reproduction of Platform content for sale, distribution for commercial purposes, for unauthorized posting or publication on other Platforms or for professional purposes, is also prohibited.
3. Third party content
The Platform may contain, use or visualize content created by third parties, information derived from public sources and/or links to external platforms or websites managed by third parties (collectively "Third Party Content"). Juno does not control or monitor Third Party Content and does not assume any responsibility or liability for the accuracy, security or reliability of Third Party Content.
Juno Go disclaims all liability to users in relation to any loss or damage that may arise or be connected with the use of third party content.
In some cases, the Platform may contain links to third party websites, which therefore do not belong to Juno or are under our management or control ("Third Party Sites"). The content of such websites is beyond the control of Juno Go, which therefore disclaims any responsibility for the credibility, completeness and legitimacy of the Third Party Sites. Juno disclaims all responsibility for the content of Third Party Sites and for any consequences resulting from access and navigation to such Third Party Sites by the user.
4. Disclaimer
Juno Go makes no warranty that the Platform, including relevant Platform content, services and features, will be uninterrupted, that any failure of the Platform will be corrected, or that use of the Platform will produce a specific result. Further, Juno does not disclaim any warranty, express or implied, including any warranty of accuracy, completeness, non-infringement of third party rights, merchantability or fitness for a particular purpose.
5. Use of the platform
5.1 Guidelines, Policies, and Applicable Law
Users may use the Platform and its content exclusively for personal, non-commercial purposes and in the manner consistent with the Terms of Use. You also agree to comply with all applicable laws, rules and regulations, and not to violate or breach any of these or any other party's rules.
The use of the Platform can in no way imply the establishment of any professional relationship with the Users, even if the latter are involved in publishing reviews, organizing or planning events or activities ("Organize"), contributions, posts of any kind or through agency relationship or editorial collaboration.
Juno Go reserves the right to suspend or temporarily stop access to or use of the Platform by the User, even without prior notice, if it considers that the terms of use of the Platform have been violated or where it is necessary for security reasons.
When the Platform uses third-party services to offer certain features and services to Juno Go members and users, users may be asked to accept te terms and conditions applied to those features or services. For example, those areas of our Platform that use location-based services where we use Google Maps and Google Earth. When you use these particular services on our Platform, you also accept the terms and conditions that Google Maps and Google Earth use.
5.2 Content from others
Juno Go does not control content from other users and members. When we become aware of inappropriate content on our Platform, we have the right to investigate and take appropriate action, but we have no obligation to monitor nor do we take responsibility for the content of others.
5.3 Interaction with others
Juno Go is not part of the activities organized through our Platform. Juno does not conduct or require background checks on members, nor do we verify statements members make. Juno does not represent or vouch for members' interactions with other members.
When using our Platform, interacting with other members and attending our activities, please do so with common sense and good judgement. If you have any concerns about this or any other member, you can always let us know and report it to [email protected].
5.4 Prohibited use of the Platform
Our platform contains confidential information and is protected by both rights and laws. Except as otherwise provided by this Agreement, you agree that you will not, directly or indirectly (a) use, arrange, organize, plan, facilitate, reproduce, modify, publish, publicly display or express, distribute or create alternative works through the Platform or any part of the Platform; (b) remove or alter ownership of any content on the Platform; (c) tamper with, disassemble, compile or discover the source code, structure, sequence or organization of the Platform; and (d) rent, lease, loan, sell, distribute or use the Platform for any commercial purpose not covered by this Agreement. You also agree that you will not use the Platform to obtain or collect (i) personal information from others except as necessary for the administration of or participation in a group or event or (ii) sensitive personal information, as defined or treated as such under applicable law (including by way of example only, health information, social security numbers and other government identifiers).
5.5 Platform security
You agree not to, either directly or indirectly, (a) extract data from the Platform for any commercial purpose not permitted by these Terms of Use, whether through the use of an automated system or software, and whether operated by a third party or ("screen scraping" , "data scraping" or "web scraping") (b) engage in any activity that disrupts or destroys, that is designed to disrupt, destroy or impose unnecessary burdens on the Platform or its systems.
You agree to use, retain and otherwise process personal data collected from the Platform in accordance with applicable laws, rules and regulations and solely for the purpose of administering and participating in Juno Go activities and events. Without limitation, you agree to notify individuals of your processing of their personal data, to obtain necessary consent and to respond to requests made by individuals in accordance with applicable law. You also agree to protect such data from unauthorized access or processing. You must delete such personal data when it is no longer strictly necessary for the administration, of a Juno Go activity or event, or immediately upon a request from Juno Go, and you will promptly certify such deletion.
5.6 Modification of the Platform
We are constantly working to improve our platform. This means that we may change or discontinue part or all of our Platform with or without notice and without liability to you or any other party.
6. Personal accounts
The User undertakes to provide personal data that are true and correct at the time of registration for a personal account and to update them regularly.
Registered users are encouraged to store their personal access data in an appropriate manner. Registered Users must immediately communicate with the Platform if unauthorized use of personal data for personal information occurs.
Registered users are responsible for all activity carried out through personal accounts and may be held liable for any damages arising from the improper use of their personal access data or for the misuse of the services provided by the personal account.
7. Planning, arranging and organizing activities and events
Each User has the ability to plan, organized and host its own activities and events ("Organized"). A User who organizes an activity or event is the "Host"; of such activity or event. This can be any kind of activity or event and can include sports, art, culture, food, drink or any other lawful activity. Hosts may charge event or activity fees for these events or activities published and offered on the Platform. If you have any questions regarding a specific activity or event, please contact the Host directly.
If you are hosting an event or activity and charging a fee, make sure you comply with all laws and regulations and declare all income required by your local tax laws.
8. Interaction with other users
Juno Go is not part of any offline activities or events published on our platform. Juno does not perform or require background checks on members or organizers, nor do we verify statements made by members. Juno does not represent or warrant the conduct of or content posted by other members, nor their interactions with other members. Use common sense and good judgment when using our platform and interacting with other users, both on our platform and at events and activities. If you have a problem with other members, users or organizers, please report it to [email protected]/resources/.10. Limitation of liability
All information about the services on the Platform is intended and published for descriptive or promotional purposes only.
Notwithstanding the commitment to ensure that all information available on the Platform is accurate and frequently updated, Juno does not warrant the correctness, completeness, accuracy or timeliness of the information available on the Platform, including, for example, the descriptions of the products, services, prices and/or indications of availability displayed on the Platform.
The Platform may modify or remove, temporarily or permanently, certain products and/or services, or change the prices of such services or other products, without notifying Users in advance of such changes or modifications.
To the extent permitted by applicable law, Juno will not under any circumstances be liable to users, customers or third parties for any damage or loss arising from the use of the Platform and/or the Platform Content.
User also agrees to indemnify and hold Juno harmless from any legal action, claim or demand by any third party, including damages and costs, including legal fees, arising out of or connected with the irregular and/or unlawful use of the Platform by Users or other persons under their control or direction.
9. Social functions
Users can interact with other users in various ways embedded in the platform ("Social Features").
The social features are intended to allow users to socially connect with other users or hosts on the platform.
Each User shall refrain from using the Social Functions to communicate or disseminate discriminatory, illegal, sexual, inappropriate or commercial content. Juno disclaims all responsibility and liability for the content contained in any messages submitted by users.
Juno Go reserves the right to access and inspect user messages, delete user messages, suspend or block the personal account or seek appropriate remedies, including appropriate legal action, if a violation of these Terms of Use is suspected and/or discovered.
